
RULES AND FORMS
These Rules are intended for use in disputes requiring a conventional arbitration process. They set the procedures that will be followed throughout the arbitration, but also permit the Parties to tailor Rules by mutual agreement to the needs of the dispute. In order to streamline the discovery process, these rules require robust initial disclosures. They also permit limited discovery without Arbitrator intervention. Dispositive motion practice is also permitted at the discretion of the parties.
Sometimes a dispute turns on a handful of legal or factual issues on which the Parties cannot agree. Such disputes can often be resolved if the issues in dispute can be determined. The Rapid Issue Arbitration Rules are intended for such disputes. They apply where the issues in dispute can be identified with specificity by mutual agreement of the Parties, there is no need for discovery, there is limited or no need for testimony, and the Parties need a prompt resolution. From start to finish, the Rapid Issue Arbitration lasts fourteen days, unless extended by agreement of the parties.
These Rules are intended for use in disputes that are narrower in scope or require rapid resolution. They call for an arbitration process that will be completed within sixty to ninety days. The parties are required to make robust initial disclosures within twenty-eight days of the filing of the arbitration demand, and to disclose witnesses and exchange of exhibits within forty-nine days of the filing of the arbitration demand. One day is allocated for the final hearing.
